OFFICIAL RULES & REGULATIONS

If you're going to enter, you should read the full rules below. To get you started, here are basic guidelines:

  • Entries will be accepted from Monday, March 7 to Friday, March 25.
  • Your entry must be compatible with Macromedia Flash Player version 7, be less than 5 MB, and have a maximum width of 550 pixels. Your entry cannot communicate with any remote servers. All entries are under a Creative Commons license, allowing non-commercial derivative works as long as they credit you and share their work in the same way.
  • Corporations and nonprofit organizations cannot enter the contest because the entry may count as an in-kind contribution.
  • You have to substantiate all facts with trustworthy sources. We'll ask you to submit these sources, in writing, with your entry.
  • Your entry cannot use copyrighted material without permission.
  • You're welcome to submit more than one entry, provided each one is truly different.
  • A team of MoveOn staff and volunteers will review every entry, evaluating how well they fulfill five criteria -- Persuasive, Original, Memorable content and delivery, Entertaining, and Motivating. We'll select 50 semi-finalists to be posted for public voting, then we'll invite MoveOn members and others to vote using the same criteria.

    In the public voting, however, the fifth and final category -- Motivating -- will include tracking how many people view each entry and then immediately sign the Social Security petition at http://www.moveonpac.org/socialsecurity/. So make sure your Flash piece encourages your audience to sign the petition. (More on this at http://www.bushin30years.org/instructions.html.) It's an easy way to get a lead on your competition.

    The 10 entries with the best public ratings will be declared finalists and sent to our panel of judges, who will determine the winner. On Wednesday, April 20, we'll announce the Grand Prize winner and the People's Choice Award winner. Both will receive an Apple PowerBook G4 with 17" display. The following week, we'll post the winning Flash on major news and youth websites. We'll also give the public (and potential clients) a way to contact the winner, if s/he so desires.

Now read on for the full contest rules:

  1. No purchase necessary.
  2. Purchasing will not improve your chances of winning. The "Bush In 30 Years" Contest ("Contest") commences at 12:01 a.m. PST on March 7, 2005, and ends at 11:59 p.m. PST on March 25, 2005. This Contest is sponsored and run by MoveOn.org Political Action, a nonprofit political organization, headquartered at 1563 Solano Ave., #368, Berkeley, CA 94707 USA ("Sponsor").
  3. Creative Commons License: ALL SUBMITTED ENTRIES MUST BE LICENSED PURSUANT TO THE CREATIVE COMMONS LICENSE (see http://creativecommons.org/licenses/by-nc-sa/2.0/legalcode) DESIGNATED FOR THIS PROMOTION. [PLEASE NOTE: An incorrect link for the license was posted earlier. The correct link was posted on March 2, 2005 at 7:00 PM ET. We apologize for any inconvenience.] ALL ENTRANTS MUST BE A U.S. CITIZEN OR U.S. RESIDENT ALIEN AND OVER 15 YEARS OLD TO ENTER. Corporations and incorporated nonprofit organizations cannot enter the contest as the entry may be seen as an in-kind contribution under the law. Participation constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules. All entries will become the property of Sponsor.
  4. Entry Criteria: Your entry should consist of your own, original "Bush In 30 Years" content in Macromedia Flash to shed light on the Republicans' Social Security scam. Your entry should effectively communicate the winners and losers under Social Security privatization in an informative, memorable, and creative way. Entries may be any form of Macromedia Flash applet, including but not limited to, animations, games, and interactive calculators. File size of entry cannot exceed 5 MB. While there is no length limit, we wouldn’t recommend anything much longer than two minutes (unless the user controls the length, as in a game). Both audio/visual and visual only entries are permitted. To be eligible for entry in the Contest, entries must be received by Sponsor by 11:59 p.m. PST, March 25, 2005.
  5. Submission of Entries: Entries may be submitted at http://www.bushin30years.org/ by filling out all requested information, on or after 12:01 a.m. PST on March 7, 2005, and before 11:59 p.m. PST on March 25, 2005. Entrants may opt-in to receive email updates from Sponsor.
  6. Respect for Existing Copyright: You must be the original author of everything in your entry or have permission to use copyright protected material. So while we want you to be creative, you need to be careful about what you put into the entry. If you're thinking about using existing music, video clips, photos or the like, odds are that someone else owns a copyright to that material and you will need to get the copyright owner's permission before using the material in your entry.
  7. Consent from Actors in Your Entry: All entrants will be required to declare that they have consent from any people appearing in your entry. Note that consent requirements may vary from state to state.
  8. Technical Requirements: Submissions will be accepted online ONLY and must follow these technical requirements:

    1. Compatible with Macromedia Flash Player version 7;

    2. Maximum width of 550 pixels;

    3. 5 MB or smaller in its final, encoded version; and

    4. Entirely self-contained with no graphics, text, or other resources from remote servers or any communication with remote servers.

  9. Substantiation: All facts and claims made within your Flash entry must be thoroughly substantiated in writing with independent documentation or sources at the time of your submission. Recommended sources are available at http://www.bushin30years.org/, but you’re welcome to do your own research as long as you can indicate a trustworthy source.
  10. Judging Criteria: Each entry will be evaluated based on how well it ranks in each of these five categories:

    1. Persuasive (20% of overall grade);

    2. Original (20% of overall grade);

    3. Memorable content and delivery (20% of overall grade);

    4. Entertaining (20% of overall grade); and

    5. Motivating (20% of overall grade).

    Viewers will be asked to rate each entry in these five categories from "5 Stars" (highest rating) to "1 Star" (lowest rating). In the semi-final (public voting) round, the fifth and final category will include tracking how many people view each entry and then immediately sign the petition at http://www.moveonpac.org/socialsecurity/. For this reason, entrants should consider including Flash code to generate a personalized petition link (available by registering for contest updates) and encourage viewers to sign the petition in their entry. A personalized link will automatically be included on the voting interface beside each entry.
  11. Judging Process: A team of MoveOn staff and volunteers will review every entry and select 50 semi-finalists to be posted for public voting. The 10 entries with the best public ratings will be declared finalists and sent to our panel of judges, who will determine the winner.
  12. Voting: Sponsor will tabulate all votes, calculate and assign each entry's weighted average rating and shall provide the top 50 rated entries as determined by the average rating of each entry (the "Semi-Finalists") to the public for online voting. Online Voting: Between April 5 and April 9, 2005, visitors to the http://www.bushin30years.org/ web site may vote for any and all posted entries by voting as described above. One vote per entry per active email address only. Online votes that are either fraudulently generated or duplicated, or associated with inactive or "dummy" email addresses, are subject to disqualification. Sponsor will tabulate all online votes, calculate and assign each entry's weighted average rating and shall provide the top 10 rated entries as determined by the average rating of each entry (the "Finalists") to the Panel Judges on or around April 11, 2005. It is not necessary to register on the web site or participate in the Contest to vote online. Please note: the online voting period ends at 11:59 p.m. PST Saturday, April 9, 2005.
  13. Panel Judges – Finalist Voting: Once the online voting has been calculated, a panel of judges (none of whom are MoveOn.org Political Action employees) will rate each of the Finalist entries also based on five categories:
    1. Persuasive (20% of overall grade);

    2. Original (20% of overall grade);

    3. Memorable content and delivery (20% of overall grade);

    4. Entertaining (20% of overall grade); and

    5. Motivating (20% of overall grade).

    The single Finalist entry with the highest average rating is the winner. Sponsor will also determine who will win the People’s Choice Award.
  14. Decisions: All grading decisions are final. Sponsor reserves the right to disqualify and remove from the web site any entry which is, in its sole discretion, inappropriate, offensive, defamatory, or demeaning to Sponsor's reputation or goodwill. Winner will be notified by e-mail, express mail and/or phone on or about April 13, 2004 and shall be required to complete an affidavit or declaration of eligibility/liability release and, except where prohibited, a publicity release and such other documents as may be required by Sponsor to protect its right to use the winning entry. Required documents must be signed and received within 7 days of the date printed on the prize notification. Failure to comply or return of any prize notification as undeliverable may result in forfeiture of prize and selection of the next highest score entrant as the winner. A parent or guardian of a winner not of the age of majority in state of residence will be required to ratify and sign required documents. Sponsor is not responsible for and shall not be liable for late, lost, misdirected, or unsuccessful efforts to notify winners. Accepting the prize constitutes permission (except where prohibited by law) to use winner's name, hometown (including state) and/or likeness for promotional purposes without further compensation
  15. Entrant: Entrant must be the sole author and copyright owner of entry, or entrant must have permission (via license or otherwise) to use or incorporate those entry portions authored or owned by third parties. Use of images, music, and other works in the public domain may be incorporated into entries; however, materials that infringe on the rights of any third party may not be used. Sponsor is not responsible for late, lost, delayed, damaged, misdirected, incomplete, illegible, or unintelligible entries. Incomplete or illegible entries are not eligible. In addition, entrant must grant to Sponsor a nonexclusive license to copy, reproduce, display, or distribute the entry, and to make derivative works based upon the entry or a substantial portion of the entry without attribution or prior permission. The winning entry, or derivative work of said entry, will be hosted on the Internet as part of an advertising campaign funded by Sponsor. The advertising will occur the week of April 25th, 2005 (time and placement shall be at the sole discretion of Sponsor).
  16. Eligibility: The Contest is open to individuals who are 15 years of age or older as of the date of entry and are legal residents of the 50 United States and the District of Columbia.
  17. Laws: This Contest is subject to all federal, state and local laws and regulations. Void in Puerto Rico, the U.S. Virgin Islands, U.S. military installations in foreign countries, and where prohibited.
  18. Sponsor: The Sponsor(s) of this Contest is MoveOn.org Political Action. Employees, independent contractors, officers, and directors of Sponsor, its affiliates, subsidiaries, advertising, promotion and fulfillment agencies, and legal advisors, and the immediate family members and persons living in the same household of such persons, are not eligible to participate in the Contest. Contest offered only in the 50 United States and the District of Columbia. Void where prohibited by law.
  19. DMCA: Sponsor complies with the provisions of the Digital Millennium Copyright Act (DMCA). In compliance with the DMCA, a Designated Agent has been established with proper documentation sent to the US Copyright Office. If you have a concern regarding the use of copyrighted material on any site on the MoveOn network, please contact the agent designated to respond to reports alleging copyright infringement.
  20. DMCA Agent: The designated agent for Sponsor to receive notification of claimed infringement under Title II of the DMCA is: Carrie Olson, MoveOn.org Political Action, 1563 Solano Ave., #368, Berkeley, CA 94707 USA, fax (360) 397-2645.
  21. Winner: Winner will be notified by mail, email, and/or phone. If the winner does not respond within 14 days of the date appearing on the prize notification, or fails to comply with the instructions contained in the prize notification within that time period, prize will be forfeited and may be awarded to an alternate winner. Return of any prize notification as undeliverable will result in disqualification. Unclaimed prizes may not be awarded. In the event of a dispute concerning the identity of the person submitting an entry online, the entry will be deemed to be submitted by the person in whose name the email account is registered. Winner may be required to provide evidence of identity in connection with claiming the prize. Income and other taxes, if any, on the value of the prize are the sole responsibility of the winner.
  22. Prizes: One prize will be given for the winning Entry and one prize will be given to the winner of the People’s Choice Award. The Grand Prize is one (1) Apple PowerBook G4 with 17" display (Approximate Retail Value ("ARV") is $2,700). The People’s Choice Award Prize is one (1) Apple PowerBook G4 with 17" display (Approximate Retail Value ("ARV") is $2,700). No prize substitution or cash redemption allowed by winner(s). Prize(s) are not transferable. Taxes are the sole responsibility of each winner. Sponsor reserves the right to substitute prize with similar prize of equal or greater value due to prize unavailability. Sponsor shall have all rights to copy, edit broadcast, publish and use, in whole or in part, the winning entry, in any manner without further compensation (except where prohibited by law). If prize, prize notification or attempted notification is returned undeliverable, prize will be forfeited and may be awarded to an alternate winner. Unclaimed prizes may not be awarded. One prize per person.
  23. Affidavit of Eligibility: Winner may be required to sign an affidavit of eligibility, a publicity release (where permitted by law), and a liability release, which must be signed and returned within 14 days of the date on the prize notification or prize will be forfeited and an alternate winner may be chosen. By entering and/or by accepting the prize, you agree (where permitted by law) to use of your name and likeness for publicity purposes without further compensation.
  24. Security: By submitting an entry, you agree that you shall not upload, post or transmit any materials which contain any computer viruses, easter eggs, worms, trojan horses or other harmful component or programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information.
  25. Participation: By participating, entrants agree that Sponsor, its shareholders, agents and representatives, affiliates, subsidiaries, advertising, promotion and fulfillment agencies, and legal advisors are not responsible or liable for, and shall be released and held harmless from: (i) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures, or difficulties of any kind; (ii) any condition caused by events beyond the control of Sponsor that may cause the Contest to be disrupted or corrupted; (iii) any printing or typographical errors in any materials associated with the Contest; (iv) any and all losses, damages, rights, claims and actions of any kind in connection with or resulting from participation in the Contest, or acceptance of the prize, including without limitation, claims based on publicity rights, defamation, or invasion of privacy. Sponsor reserves the right, in its sole discretion, to suspend or cancel Contest at any time if a computer virus, bug, or other technical problem corrupts the administration, security, or proper conduct of the Contest. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with the laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of California or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of California.
  26. Lost, Misdirected or Stolen, etc. Entries: All entries become the property of Sponsors and will not be acknowledged or returned. Sponsors are not liable for lost, stolen, misdirected, or late entries.
  27. This Contest is governed by the laws of the United States with venue in San Francisco County in the State of California. The formation, interpretation and performance of this agreement shall be governed by the laws of the State of California applicable to agreements made and to be performed by California residents entirely within the State of California without regard to its conflicts of law provisions.
  28. Winners List/Official Rules: A copy of these official rules and a winners list may be obtained by writing to MoveOn.org Political Action, 1563 Solano Ave., #368, Berkeley, CA 94707 USA or faxing a request to (360) 397-2645. Requests for winners list must be received by May 30, 2005.
  29. Privacy Policy: Information collected from entrants is subject to Sponsor’s security and privacy policy, namely, Sponsor treats your contact information as private and confidential. Sponsor will not provide your contact information to any other organization except MoveOn.org unless you specifically authorize us to do so. Sponsor will send you updates by e-mail. Sponsor will do its best to respect your time and attention. You can remove yourself from the mailing list at any time. On rare occasions, Sponsor may also contact you by phone to coordinate your participation in MoveOn events. Please contact us if you have any questions. Please submit unanswered questions here.
